Welcome to In ArchDesign ("ArchDesign", "Firm", "we", "us", "our"). By accessing or browsing our website (https://inarchdesign.in/), submitting an onboarding form, accepting a project proposal/quotation, or making an online fee payment, you ("Client", "User", "you") explicitly agree to be bound by these Terms & Conditions, our Privacy Policy, and any written agreement executed between you and ArchDesign.

These Terms constitute a legally binding agreement under the Indian Contract Act, 1872. If you do not agree with any part of these Terms, you must refrain from utilizing our website or engaging our professional services.

ArchDesign provides comprehensive interior design, space planning, 3D visualization, custom furniture manufacturing, architectural consultancy, and turnkey execution services across residential, commercial, hospitality, corporate, and healthcare sectors.

• Design & Concept Phase: Initial site measurement, layout planning, 3D interior renders, material selections, and Bill of Quantities (BOQ).
• Turnkey Execution Phase: Civil work, carpentry, electrical, plumbing, ceiling, painting, custom furniture fabrication, and site installation.
• Project Proposals: Specific deliverables, milestone schedules, material grades, and payment structures are explicitly detailed in individual project estimates provided prior to project commencement.

To enable timely and high-quality project execution, the Client agrees to:

• Provide timely site access, unhindered entry for design engineers and execution personnel, working electricity, and water supply during execution hours.
• Obtain all requisite approvals, NOCs, society permissions, and municipal consents required from local authorities or housing societies (e.g. PMC/PCMC/housing society rules).
• Review and approve 2D layouts, material samples, and 3D renders in a timely manner according to agreed project timelines.

All project costs, design retainer fees, and execution installments are quoted based on finalized BOQs and site measurements.

• Advance Retainer Payment: Required upon signing the agreement to initiate site measurements, 2D/3D design layouts, and technical drawings.
• Stage Milestone Payments: Payments are structured across defined stages (e.g., 20% Booking, 30% Design Approval & Production Launch, 40% Material On-Site/Carpentry Execution, 10% Pre-Handover).
• Statutory Taxes (GST): All fees and costs quoted are subject to applicable Goods and Services Tax (GST) as mandated by the Government of India. Formal Tax Invoices bearing ArchDesign’s GSTIN are issued for all payments.

ArchDesign provides convenient and secure digital payment options for design consultancy retainers, invoice settlements, and project milestone payments. Online payments on our portal or digital invoice payment links are powered by Razorpay Software Private Limited ("Razorpay").

By making an online payment to ArchDesign via Razorpay, you acknowledge and agree to the following terms:

• Authorized Payment Modes: Payments can be executed via UPI (Google Pay, PhonePe, Paytm, BHIM), Net Banking across major Indian banks, Debit Cards, Credit Cards (Visa, MasterCard, RuPay, Amex), and bank transfer mechanisms supported on the Razorpay gateway.
• Transaction Security & Authentication: Transactions are secured with 256-bit SSL encryption and Two-Factor Authentication (2FA) as mandated by the Reserve Bank of India (RBI). Clients are responsible for ensuring that the payment instrument used belongs to them or is lawfully authorized.
• Payment Confirmation: A payment is deemed successful only upon positive settlement notification from Razorpay and credit receipt in ArchDesign’s bank account. ArchDesign is not responsible for failed transactions caused by bank server downtimes, incorrect OTP entry, or insufficient funds.
• Gateway Convenience Charges: Unless explicitly stated otherwise, standard payment processing fees charged by Razorpay are absorbed or disclosed upfront prior to transaction completion.

Because architectural and interior design services involve custom site measurements, tailored 3D renders, and bespoke furniture manufacturing, refunds are governed by the following strict rules:

All architectural designs, 3D renderings, CAD drawings, spatial concepts, mood boards, custom furniture blueprints, photographs, and website content created by ArchDesign remain the exclusive intellectual property of In ArchDesign protected under the Copyright Act, 1957 of India.

Upon full payment of project fees, the Client receives an exclusive license to enjoy the executed physical interior space. However, Clients may not commercialize, reproduce, resell, or distribute ArchDesign's proprietary architectural drawings or 3D design files to third-party contractors without prior written consent.

ArchDesign takes pride in its craftsmanship and provides a signature 10-Year After-Sales Service Commitment for custom woodwork, modular cabinetry, and structural interior elements executed by our team.

To the maximum extent permitted by law, ArchDesign, its partners, designers, and employees shall not be liable for any indirect, incidental, consequential, or punitive damages arising from site delays caused by society restrictions, client-driven design changes, raw material supply chain disruptions, or third-party vendor failures.

In all events, the total cumulative liability of ArchDesign under any claim shall not exceed the professional design fee actually paid by the Client to ArchDesign for the specific project stage in question.

These Terms & Conditions, all project agreements, and digital transactions shall be governed by and construed in accordance with the laws of the Republic of India.

In the event of any dispute, controversy, or claim arising out of or relating to our services, the parties shall first attempt friendly resolution through mutual discussions. If unresolved, any legal proceedings shall be subject to the exclusive jurisdiction of the competent courts in Pune, Maharashtra, India.
